It should not be confused with the Public Administration\u2019s contingency, management reserve, insurance, profit, or compensation for an extraordinary event. The way risk is estimated also determines how it should be measured, paid, and addressed throughout execution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When risk is continuous and embedded in BDI, remuneration normally follows the contract\u2019s physical progress. When the model identifies a discrete or binary event, the logic may differ: economic treatment should be conditional on occurrence and on the rule established in the matrix. In both cases, the principle is the same: do not pay twice for the same risk and do not use an amendment, price adjustment, or revision to restore a component that was already adequately remunerated.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Risk allowance originates in the risk matrix<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Risk allowance connects the risk matrix, BDI, measurement, and any subsequent amendment. The estimate needs to reflect that allocation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the Public Administration transfers a particular risk to the contractor, the market tends to price that exposure. The component may appear in different forms, depending on the method:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>risk percentage in BDI;<\/li><li>contingency calculated by risk;<\/li><li>parametric component;<\/li><li>specific provision;<\/li><li>insurance premium;<\/li><li>productivity adjustment;<\/li><li>price conditional on occurrence of an event, where the contractual design allows it.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The error is to treat all of these forms as independent additions. The <a href=\"\/conteudo\/artigos-tecnicos\/matriz-alocacao-riscos-contratos-engenharia-lei-14133\/\">Risk Allocation Matrix<\/a> should be the origin of the calculation memorandum.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Risk in BDI is not generic contingency<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">TCU Decision 2,622\/2013-Plenary consolidated the BDI rate with components such as head-office overhead, risks, insurance, guarantees, financial expenses, profit, and taxes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The risk component exists to absorb exposures compatible with the ordinary uncertainty of execution and with the risks effectively assumed by the contractor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This does not authorize insertion of an arbitrary \u201crisk\u201d percentage without a calculation memorandum.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A defensible rate needs to answer:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>which risks are being remunerated;<\/li><li>why they belong to the contractor;<\/li><li>which method was used to quantify them;<\/li><li>whether insurance or contingencies already exist for the same exposure;<\/li><li>whether the risk is continuous or discrete;<\/li><li>how remuneration will be appropriated during execution.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">Ordinary and extraordinary risk cannot be mixed<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ordinary risk is inherent to the activity and reasonably foreseeable within the procurement. Extraordinary risk arises from events that, according to legislation, the matrix, and the circumstances, may justify a specific compensation mechanism.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The BDI risk rate should not be used to absorb every future event, including those classified as extraordinary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">TCU case law itself distinguishes ordinary risks from extraordinary uncertainty and warns against overlap between price adjustment and compensation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The article on <a href=\"\/conteudo\/artigos-tecnicos\/revisao-reajuste-repactuacao-contratual-engenharia\/\">Contract Revision, Price Adjustment, and Repactuation<\/a> helps separate each mechanism.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The estimating methodology determines the payment criterion<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The TCU\u2019s 2026 Guide to Cost Engineering in Public Works makes an important point: the payment method cannot be defined first and the risk-estimating method chosen afterward.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The logic should be the reverse.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Continuous risk<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is risk whose exposure accompanies execution and can be distributed throughout the contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Examples may include ordinary productivity variations, small losses, and recurring uncertainties consistent with the matrix.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When the risk is incorporated into BDI, its remuneration follows the price of the measured services.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Discrete or binary risk<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is risk associated with an identifiable event that may or may not occur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Conceptual example: the need for additional mobilization resulting from a specific condition mapped in advance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this case, the methodology may provide for treatment conditional on the event, provided the tender defines the trigger, evidence, and quantification method.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Risk embedded in BDI follows physical progress<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When the risk component is included in BDI, it is applied to the services paid.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means remuneration grows in the same proportion as measured physical execution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a rule, there is no separate \u201crisk measurement\u201d each month.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Simple example:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>direct cost measured in the month: BRL 1,000,000;<\/li><li>contractual BDI: 25%;<\/li><li>risk component within BDI: 1%.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The risk component is embedded in the final price. It should not be charged again as a standalone item.<\/p>\n\n\n\n<div class=\"wp-block-a3a-destaque\">\n<p class=\"wp-block-paragraph\"><strong>When the risk matrix, BDI, contingency, and insurance are calculated separately, the same risk may be remunerated more than once without the worksheet making this evident.<\/strong> Reconciliation should occur before the tender, with traceability among event, responsible party, quantification method, and economic component.<\/p>\n\n\n<p class=\"wp-block-paragraph\"><a href=\"\/servicos\/servicos-transversais\/gerenciamento-de-riscos-de-engenharia\/\">Engineering Risk Management to reconcile the matrix, contingency, insurance, and residual risk<\/a><\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">The same risk cannot appear twice in the worksheet<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Duplication may occur in several ways.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Risk in BDI and contingency<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If an exposure has already been priced as a contractor risk in BDI, adding contingency for the same consequence creates overlap.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Risk in BDI and insurance<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If the event has been transferred to an insurer and the premium is fully budgeted, the residual component needs to be identified before additional risk remuneration is maintained.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Risk in BDI and contract amendment<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An event foreseen and assumed by the contractor should not automatically generate a contract increase when it materializes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Risk in BDI and revision<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If the exposure was already ordinary and remunerated, later treating it as an extraordinary event changes the original allocation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"\/conteudo\/artigos-tecnicos\/reserva-contingencia-projetos-engenharia-prazo-custo\/\">Contingency Reserve<\/a> should be reconciled with the matrix and BDI.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Insurance reduces exposure but does not necessarily eliminate risk<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">An insurance policy has:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>deductible;<\/li><li>limit;<\/li><li>sublimits;<\/li><li>exclusions;<\/li><li>term;<\/li><li>coverage conditions.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, residual risk may remain even when insurance exists.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The correct analysis does not ask only \u201cis there insurance?\u201d It asks what portion of the risk was transferred and what portion remained with the contractor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The article on <a href=\"\/conteudo\/artigos-tecnicos\/seguro-obras-publicas-risco-engenharia-segurabilidade-bdi\/\">Public Works Insurance<\/a> explores this integration in greater depth.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to avoid duplication among risk, insurance, and contingency<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">An economic matrix can be structured as follows:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td>Event<\/td><td>Gross exposure<\/td><td>Insurance<\/td><td>Deductible\/residual limit<\/td><td>Contingency<\/td><td>Risk allowance<\/td><\/tr><tr><td>Event A<\/td><td>100<\/td><td>70<\/td><td>30<\/td><td>0<\/td><td>30<\/td><\/tr><tr><td>Event B<\/td><td>100<\/td><td>0<\/td><td>100<\/td><td>60<\/td><td>40<\/td><\/tr><tr><td>Event C<\/td><td>100<\/td><td>100<\/td><td>0<\/td><td>0<\/td><td>0<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The values are illustrative only. The purpose is to show reconciliation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each monetary amount should have only one economic function.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Risk that does not materialize may generate legitimate efficiency gain<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">An important characteristic of risk pricing is that the event may not occur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the contractor legitimately assumed a risk and priced that exposure, the absence of the event does not automatically mean the remuneration should be returned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is how risk works economically.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The report underlying TCU Decision 2,622\/2013-Plenary recognizes that risk components may remain in the margin when the exposure does not materialize, provided there is no overpricing, duplication, or improper transfer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This point is important because contracts that confiscate any legitimate gain discourage efficiency and make the risk matrix fictitious.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Efficiency gain is not payment for a nonexistent event<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Two situations need to be distinguished.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the first, risk was incorporated into the total price or BDI. The contractor bore the exposure throughout execution and may have gained when the event did not occur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the second, the contract created a specific payment conditional on a particular event. If the event did not occur, there is no basis for payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The difference lies in the contractual methodology.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For this reason, the tender needs to state which model it adopts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Should the risk allowance be price-adjusted?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When risk is embedded in BDI and follows the services, it is part of the contract price and follows the general mechanism applicable to that price.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A separate price adjustment for the risk component should not be created as though it were an independent account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the Public Administration grants extraordinary revision for a specific event, it must also avoid overlap with price adjustment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">TCU Decision 1,431\/2017-Plenary is an important reference for preventing bis in idem among compensation mechanisms.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Price adjustment does not replace revision, and revision does not replace price adjustment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Price adjustment restores ordinary inflationary loss according to the index and periodicity established in the contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Revision addresses extraordinary events under the statutory hypotheses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If an extraordinary event increased cost and the same effect was later absorbed by the adjustment index, the compensation needs to be recalculated to prevent double coverage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Likewise, revision should not be denied merely because a price-adjustment mechanism exists.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They are different instruments.<\/p>\n\n\n\n<div class=\"wp-block-a3a-destaque\">\n<p class=\"wp-block-paragraph\"><strong>A contract amendment should not mechanically reapply the original risk rate.<\/strong> It is necessary to demonstrate whether the new scope preserves the previous exposure, creates new risks, eliminates risks already remunerated, or changes schedule, method, and interfaces. Without this analysis, the amendment may carry duplicate remuneration or leave a new exposure untreated.<\/p>\n\n\n<p class=\"wp-block-paragraph\"><a href=\"\/servicos\/implementacao\/analise-tecnica-aditivos-alteracoes-escopo-pleitos-contratos-engenharia\/\">Technical Analysis of Amendments, Scope Changes, and Claims<\/a><\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">How to address risk allowance in contract amendments<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A contract change may alter risk exposure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Examples:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>increase in quantities;<\/li><li>change in execution method;<\/li><li>extension of time;<\/li><li>introduction of a new interface;<\/li><li>change in geotechnical conditions;<\/li><li>change of location;<\/li><li>replacement of technology.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The amendment analysis needs to verify whether the risk originally priced remains proportional to the new scope.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Applying the same rate to every increase is not automatic.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quantitative amendment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If there is an increase in the quantity of a service carrying the same risk profile, maintaining the original composition may be coherent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But this depends on the matrix and on the nature of the item.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Qualitative amendment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A change in solution may create new risks, eliminate existing risks, or change probability and impact.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In that case, repeating the previous rate without analysis may create a distortion.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Extension of time<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Additional time may increase exposure to some risks, but not necessarily to all of them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Time-related risks need to be identified separately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The article on <a occurs, the first question is not \u201cwhat is the cost?\u201d It is \u201cwho owned the risk?\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The matrix should guide:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>responsibility;<\/li><li>notification obligation;<\/li><li>evidence;<\/li><li>notification deadline;<\/li><li>quantification method;<\/li><li>time treatment;<\/li><li>cost treatment;<\/li><li>applicable insurance;<\/li><li>need for revision.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Without this sequence, the discussion becomes an ex post negotiation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Events outside the matrix require specific analysis<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">No matrix can anticipate every possible condition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unforeseen events need to be analyzed in light of:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>the law;<\/li><li>the contract;<\/li><li>the nature of the event;<\/li><li>foreseeability;<\/li><li>causation;<\/li><li>the conduct of the parties;<\/li><li>mitigation capability;<\/li><li>materiality.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The absence of an explicit line does not automatically mean the risk belongs to the Public Administration or to the contractor.<\/p>\n\n\n\n<div class=\"wp-block-a3a-destaque\">\n<p class=\"wp-block-paragraph\"><strong>A risk rate without a calculation memorandum does not demonstrate what is being paid or allow the value to be reviewed when design, method, or exposure changes.<\/strong> Cost Engineering should convert relevant events into assumptions, ranges, expected values, or distributions compatible with project maturity.<\/p>\n\n\n<p class=\"wp-block-paragraph\"><a href=\"\/servicos\/planejamento\/orcamento-obras-servicos-engenharia\/\">Cost Engineering to quantify risk, contingency, and BDI with traceability<\/a><\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">How to quantify the risk allowance<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The methodology should be proportional to project maturity and the data available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Methods may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>historical project data;<\/li><li>structured expert judgment;<\/li><li>parametric modeling;<\/li><li>stochastic simulation;<\/li><li>scenario analysis;<\/li><li>probability distributions;<\/li><li>market data;<\/li><li>a combination of methods.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The choice should be documented.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A simple percentage method requires justification<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A single percentage may be adequate for simple, well-known scopes, but it should not be applied merely by tradition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Minimum questions:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>What historical basis supports the percentage?<\/li><li>Which risks are included?<\/li><li>Which project phase was considered?<\/li><li>Is there double counting?<\/li><li>Does the percentage remain valid for the current scope?<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Without answers, the number is merely a convention.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Risk-by-risk modeling improves traceability<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A more robust approach breaks each event down into probability and impact.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Example:<\/p>\n\n\n\n<figure risks may distort a simple sum<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Rainfall, productivity, schedule, and indirect costs may be correlated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Adding expected values without treating dependence may understate or overstate exposure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The TCU\u2019s 2026 Guide reinforces the need for methodological consistency in probabilistic analyses.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The allowance should reflect project maturity<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">An immature design has greater uncertainty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This does not automatically mean applying a higher percentage without analysis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Maturity influences:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>number of risks;<\/li><li>width of ranges;<\/li><li>quality of quantities;<\/li><li>confidence in prices;<\/li><li>degree of geotechnical
