The problem is not simply performing expensive activities at the beginning of the project: certain mobilizations, acquisitions, temporary facilities, or construction stages may legitimately concentrate costs early. The risk arises when the financial distribution departs from the effective addition of physical value to the project and changes the balance of incentives over the life of the contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case law of Brazil\u2019s Federal Court of Accounts (TCU), schedule gaming is associated with the risk that the Public Administration may pay in advance an economic portion disproportionate to actual progress and later face reduced contractor interest, deficient execution, the need for renegotiation, or even abandonment of the final stages. In linear projects or projects divided into sections, the same phenomenon may occur when more profitable or easier-to-execute segments are prioritized and more difficult or less remunerated portions are left for the end.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prevention depends on a coherent chain: sufficiently mature design, reliable estimate, price acceptability criteria, realistic physical-financial schedule, payment stages linked to verifiable results, proposal analysis before contract award, and inspection that compares physical, financial, and documentary progress. In contracts procured on a lump-sum basis, Law No. 14,133\/2021 reinforces this logic by requiring measurement and payment to be associated with stages of the physical-financial schedule linked to achievement of performance targets.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For this reason, schedule gaming should be treated as an engineering, procurement, and financial-control risk. It often originates before construction begins, in the way the design, estimate, bid, and payment rules are structured, and may materialize during execution when the physical sequence is changed without economic analysis, when stages are advanced without evidence of benefit, or when measurement ceases to reflect the result actually delivered.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How schedule gaming is formed<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Schedule gaming is a risk that cuts across estimating, bidding, measurement, and execution rescheduling. The physical dimension shows when each stage, work front, or deliverable will be executed. Looking only at dates does not reveal the problem. Estimate failures require review of the preparatory phase. Distortions in the bid must be analyzed before award. Changes during construction require inspection, analysis of contractual impact, and justification for the rescheduling.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Schedule gaming is not any acceleration of activity<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Sequencing is a normal part of construction planning. Construction method, logistics, interferences, area availability, permits, weather, supply conditions, productivity, and operational constraints may justify changes in the order of activities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An acceleration becomes a warning sign only when it combines economic and technical factors that require explanation. Performing a higher-value stage first does not automatically characterize schedule gaming. The control point is precisely to prevent a generic operational justification from being used to substantially modify the contract\u2019s economic profile.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, every significant change in sequence should be analyzed together with the estimate and the risk matrix, not merely approved as a graphical revision of schedule bars.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Difference between schedule gaming and bid-sheet manipulation<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The two risks are related, but they are not identical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <a href=\"\/conteudo\/artigos-tecnicos\/mergulho-precos-licitacoes-obras-jogo-planilha-aditivos\/\">bid-sheet manipulation<\/a>, the main distortion lies in the prices and quantities of individual items. The event schedule defines when that result becomes eligible for measurement and payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A well-designed payment stage should be:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>technically verifiable;<\/li><li>associated with an objective deliverable or result;<\/li><li>proportional to the value actually added;<\/li><li>sufficiently independent to allow acceptance;<\/li><li>documentable through evidence;<\/li><li>compatible with the execution sequence;<\/li><li>unable to advance margin without equivalent physical consideration.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Excessively subdividing stages may also be problematic. Very small milestones may effectively recreate unitized measurement within a delivery model intended to remunerate results. On the other hand, excessively broad stages may create cash-flow difficulties and disputes over progress percentages.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The balance depends on the engineering of the scope. There is no universal number of milestones applicable to every project.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Lump-sum delivery models and Law No. 14,133\/2021<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Article 46, paragraph 9, of Law No. 14,133\/2021 establishes that lump-sum contracts, full-scope contracts, task-based contracting, integrated contracting, and semi-integrated contracting are procured at a total price and adopt a measurement and payment system associated with the execution of stages in the physical-financial schedule linked to achievement of result targets. Under these models, remuneration should not be driven by unit prices or by execution of quantities of unit items.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This rule is central to understanding control of schedule gaming. Under a unit-price model, the quantity actually executed plays a direct role in measurement. Under a lump-sum model, the logic should prioritize the stage, milestone, or planned deliverable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This does not mean that unit prices cease to exist or become irrelevant. They remain important in preparing the estimate, the bid, price analysis, and exceptional situations involving contractual adjustment. The difference lies in the remuneration system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When a lump-sum project is measured as though it were unit-price work, an additional problem arises: the contractor may prioritize more profitable items or sections, receive payment for them, and postpone less attractive portions. In linear projects, this risk is especially visible when apparently homogeneous sections have very different difficulties and costs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to analyze the bid schedule before contract award<\/h2>\n\n\n\n<div class=\"wp-block-a3a-destaque\">\n<p class=\"wp-block-paragraph\">The winning bid needs to be read as a system: price, sequence, execution method, physical curve, and financial curve. A schedule that forecasts major physical progress without compatible resources may indicate a planning inconsistency; conversely, high resource levels and disbursements with little physical progress also require explanation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Analysis of equipment, mobilization, supplies, and subcontracting adds other evidence. The objective is not to impose the Public Administration\u2019s curve on the contractor, but to verify whether the bid is technically executable and whether the payment profile protects the public interest.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Advance procurement of materials and changes in sequence<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">High-value materials are one of the most sensitive points.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In certain projects, early procurement may reduce supply-shortage risk, secure fabrication of a long-lead item, preserve price, or lock in a delivery window required by the critical path. These benefits may justify an advance-procurement strategy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The problem arises when procurement, measurement, and payment are treated as equivalent.
