{"id":74606,"date":"2026-09-04T18:03:35","date_gmt":"2026-09-04T21:03:35","guid":{"rendered":"https:\/\/a3aengenharia.com\/?post_type=articles&#038;p=74606"},"modified":"2026-09-04T18:03:35","modified_gmt":"2026-09-04T21:03:35","slug":"proof-concept-statement-work-engineering-validate-solution-before-implementation","status":"publish","type":"articles","link":"https:\/\/a3aengenharia.com\/en-us\/content\/technical-articles\/proof-concept-statement-work-engineering-validate-solution-before-implementation\/","title":{"rendered":"Proof of Concept and Statement of Work in Engineering: How to Validate the Solution Before Implementation"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Proof of Concept (PoC) and Statement of Work (SOW) are different and complementary instruments. In an engineering contract, the PoC serves to demonstrate, through a test or objective assessment, that a proposed solution meets previously defined requirements. The Statement of Work, in turn, describes how the work will be performed: scope, boundaries, deliverables, responsibilities, methodology, team, schedule, controls, documents, tests and completion criteria.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The distinction is decisive because a procurement may prove that a supplier has experience and still need to validate specific aspects of the solution or mobilization. Qualification answers whether the bidder meets the capability requirements defined in the tender documents; the PoC may answer whether the offered solution demonstrates a given level of compliance; and an SOW or Execution Plan may answer how the contractor intends to organize execution of that specific contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Brazil&#8217;s Law No. 14,133\/2021, proof of concept has an express legal basis: Article 17, paragraph 3, allows compliance analysis of the provisionally successful bidder&#8217;s proposal through samples, compliance examination and proof of concept, among other tests, provided these are established in the tender documents. The English term Statement of Work, however, does not constitute an autonomous stage of Brazilian public procurement. When a document with this function is required in a public contract, its obligation, content, timing and consequence must be anchored in the Terms of Reference, tender documents or contract, without becoming a retroactive qualification requirement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The correct combination is powerful: <strong>PoC to demonstrate requirements that need to be tested; SOW or Execution Plan to turn the contract into a verifiable method, set of responsibilities and sequence before implementation<\/strong>. When these instruments are planned from the preparatory phase, they create a barrier between \u201ccompany selected\u201d and \u201cexecution released\u201d without confusing competition, qualification, proposal compliance and contract management.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">PoC and SOW answer different questions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The proof of concept tests a statement about the solution. A PoC should not be used to subjectively select the \u201cbest idea\u201d when the tender documents established objective evaluation criteria. An SOW should not appear after qualification as an additional capability test that nobody knew they would have to meet.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">When a Proof of Concept adds real value<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A PoC is useful when a critical characteristic of the solution cannot be safely confirmed solely through declaratory documentation, a catalog or certification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Examples may include, depending on the scope:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>interoperability between systems;<\/li><li>ability to process a given volume;<\/li><li>adherence to a specific functional requirement;<\/li><li>compatibility with the existing environment;<\/li><li>measurable performance in a defined scenario;<\/li><li>execution of a critical workflow;<\/li><li>reading, exporting or integrating data;<\/li><li>demonstration of a security or control function;<\/li><li>validation of an interface with legacy technology.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A PoC is not advisable simply because the contracting authority \u201cwants to see it working.\u201d The requirement must be relevant, testable and proportionate to the effort imposed on the bidder.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/licitacoesecontratos.tcu.gov.br\/5-4-1-2-amostra-e-prova-de-conceito\/\">TCU guidance on samples and proof of concept<\/a> reinforces that the requirement must be justified and supported by objective criteria. The test must assess what the tender documents defined, not preferences discovered during the session.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to specify an objective PoC<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A defensible PoC starts before the procurement, in the design of the requirements. The vaguer the specification, the greater the probability that the test becomes subjective.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A PoC matrix may contain:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td>ID<\/td><td>Requirement<\/td><td>Test procedure<\/td><td>Input<\/td><td>Expected result<\/td><td>Evidence<\/td><td>Criterion<\/td><\/tr><tr><td>POC-01<\/td><td>integration with protocol X<\/td><td>connect and run scenario<\/td><td>defined environment<\/td><td>successful communication<\/td><td>log + screen + file<\/td><td>pass\/fail<\/td><\/tr><tr><td>POC-02<\/td><td>minimum performance<\/td><td>run established load<\/td><td>standard dataset<\/td><td>value \u2265 limit<\/td><td>exported report<\/td><td>pass\/fail<\/td><\/tr><tr><td>POC-03<\/td><td>export<\/td><td>generate file in required format<\/td><td>test data<\/td><td>valid file<\/td><td>native file<\/td><td>pass\/fail<\/td><\/tr><tr><td>POC-04<\/td><td>workflow<\/td><td>run functional sequence<\/td><td>action script<\/td><td>steps completed<\/td><td>execution record<\/td><td>pass\/fail<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The script should also specify the environment, duration, responsibility for infrastructure, conditions for repetition, tolerances, failure handling, documentation and how results will be recorded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When the assessment depends on human judgment, the criteria must be broken down into observable elements. Expressions such as \u201cuser-friendly interface,\u201d \u201cgood performance\u201d or \u201csatisfactory integration\u201d are insufficient without a scale or verification criterion.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">PoC is not a commercial demonstration<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A commercial demonstration and a proof of concept are not synonymous. A demo normally presents functions chosen by the supplier in an environment controlled by the supplier. A contractual PoC tests requirements chosen by the contracting authority, according to a known script and defined evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction avoids a common trap: the supplier giving a convincing presentation that does not test the critical conditions of the scope.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the PoC, the contracting authority should control the question. The supplier demonstrates the answer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Transparency and observability of the test<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The procedure must be auditable. The TCU has precedents requiring detailed criteria and allowing interested parties to follow the assessment, subject to the rules of the procurement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means recording:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>date and environment;<\/li><li>participants;<\/li><li>product or solution version;<\/li><li>requirements tested;<\/li><li>procedure applied;<\/li><li>input data;<\/li><li>observed result;<\/li><li>evidence generated;<\/li><li>deviations and events;<\/li><li>conclusion for each requirement;<\/li><li>overall conclusion.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">When the test produces a native file, preserving it may be more useful than an isolated PDF report. Logs, configuration files, exports, technical captures and hashes can strengthen traceability when the scope justifies this level of control.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Where the Statement of Work fits<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Statement of Work is a term used in project management, contracts and procurement to describe the work to be performed. In Portuguese, its function may be distributed among scope, technical specification, work plan, execution plan, service order or equivalent documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The most important point is the function, not the language: <strong>turning a contractual obligation into a verifiable operational description<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A good SOW reduces gray areas by making explicit:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>work objective;<\/li><li>scope boundaries;<\/li><li>exclusions and assumptions;<\/li><li>deliverables;<\/li><li>packages and sequence;<\/li><li>responsibilities;<\/li><li>interfaces with the contracting authority and third parties;<\/li><li>team and roles;<\/li><li>methodology;<\/li><li>schedule and milestones;<\/li><li>documents and submittals;<\/li><li>quality criteria;<\/li><li>inspections and tests;<\/li><li>change control;<\/li><li>completion and handover criteria.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In public procurement, these elements cannot contradict or rewrite the scope after the bidding. The SOW should detail execution within the established obligations, not silently renegotiate what was procured.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SOW cannot become hidden qualification<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is probably the greatest risk of using the Statement of Work concept post-award.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine tender documents that require only experience certificates and a minimum team. After qualification, the contracting authority requests an SOW and decides that it will reject the company if the methodology \u201cdoes not demonstrate sufficient maturity,\u201d even though no prior criteria exist. In practice, a new qualification barrier would have been created after the bidding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The solution is to establish from the contracting stage:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>that the document will be required;<\/li><li>its minimum content;<\/li><li>when it will be submitted;<\/li><li>how it will be reviewed;<\/li><li>which items may generate comments or require revision;<\/li><li>which conditions prevent the Notice to Proceed;<\/li><li>which aspects are planning matters only and do not modify scope;<\/li><li>how differences will be resolved.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In this way, the document functions as a contract-management instrument, not an improvised filter.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">From the SOW to the Execution Plan<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In implementation contracts, the SOW often needs to be supplemented by a more operational Execution Plan. The former establishes what will be done and how the work is structured; the latter can detail actual mobilization, work fronts, resources, methods and controls.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A practical structure may contain:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Scope and WBS<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The WBS breaks the contract into controllable parts and creates a link with schedule, measurement and deliverables.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Organization and RACI<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The RACI matrix or equivalent identifies who performs, is accountable, is consulted and is informed for critical decisions.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Schedule and milestones<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The schedule must reflect execution logic, dependencies, constraints, approvals, procurement, tests and handover \u2014 not merely start and finish dates.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Materials and submittals<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Critical items should have a datasheet, equivalence requirement, review workflow and approval deadline compatible with the schedule.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">QA\/QC<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The quality plan and ITP\/PIT should define inspections, criteria and witness points.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Document management<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The deliverables matrix must establish progressive documents, revisions and their relationship with measurement and acceptance.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Testing and commissioning<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Tests must be planned from the beginning, with prerequisites, instruments, evidence and criteria.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Handover<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">As-Built, Data Book, manuals, warranties and training should not appear as \u201cfinal pending items\u201d; they need to be planned from mobilization onward.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Terms of Reference must prepare the ground<\/h2>\n\n\n\n<div class=\"wp-block-a3a-destaque\">\n<p class=\"wp-block-paragraph\">PoC, SOW, acceptance criteria and gates only work when designed in the preparatory phase and clearly stated in the procurement documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Technical review of the Terms of Reference makes it possible to separate qualification requirements, proposal requirements, compliance testing and execution obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/a3aengenharia.com.br\/servicos\/planejamento\/termo-referencia-obras-servicos-engenharia\/\">Structure or review the Terms of Reference<\/a><\/p>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">If the organization intends to use PoC, SOW or a pre-start gate, the design begins in the <a href=\"https:\/\/a3aengenharia.com.br\/servicos\/planejamento\/termo-referencia-obras-servicos-engenharia\/\">Terms of Reference for Public Works and Engineering Services<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Brazil&#8217;s Law No. 14,133\/2021 includes in the ToR content elements such as contracting requirements, execution model, contract-management model, measurement and payment criteria and supplier-selection method. This makes it possible to build a coherent journey between requirement, assessment and execution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ToR needs to distinguish:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>scope requirement;<\/li><li>evidence required in the proposal;<\/li><li>qualification evidence;<\/li><li>requirement tested in the PoC;<\/li><li>document required after contracting;<\/li><li>pre-Notice-to-Proceed condition;<\/li><li>execution evidence;<\/li><li>measurement criterion;<\/li><li>acceptance criterion.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This separation reduces the chance that the same requirement will be demanded in different and contradictory ways throughout the process.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Design Review as a third layer<\/h2>\n\n\n\n<div class=\"wp-block-a3a-destaque\">\n<p class=\"wp-block-paragraph\">Passing a PoC does not mean the detailed design is mature. Interfaces, constructability, materials, details and test criteria need to be verified before each package is released.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Design Review reduces the cost of correcting incompatibilities after they have already been incorporated in the field.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/a3aengenharia.com.br\/servicos\/planejamento\/revisao-validacao-tecnica-projetos-design-review\/\">Technical Design Review and Validation \u2014 Design Review<\/a><\/p>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">PoC demonstrates a characteristic of the solution; SOW organizes the work; neither replaces review of the detailed design.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When implementation depends on detailed design, shop drawings or details produced by the contractor, <a href=\"https:\/\/a3aengenharia.com.br\/servicos\/planejamento\/revisao-validacao-tecnica-projetos-design-review\/\">Design Review<\/a> addresses interfaces, requirements, compatibility, constructability and maturity before execution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A typical sequence may be:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>requirements defined in the design\/ToR;<\/li><li>proposal assessed;<\/li><li>PoC applied to testable requirements, when applicable;<\/li><li>contract formalized;<\/li><li>SOW\/Execution Plan submitted;<\/li><li>detailed design and submittals reviewed;<\/li><li>critical pending items closed;<\/li><li>Notice to Proceed or package release.<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">This logic creates independent barriers. A solution can pass the PoC and still have an inadequate design detail. An excellent design can fail if the Execution Plan does not provide coherent resources or sequencing. Each instrument verifies a different dimension.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Project Controls turns the plan into a baseline<\/h2>\n\n\n\n<div class=\"wp-block-a3a-destaque\">\n<p class=\"wp-block-paragraph\">An SOW without a baseline becomes only an approved document. WBS, schedule, milestones and deliverables need to feed a control system that shows planned, actual, variance and forecast.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Project Controls turns the plan into a measurable reference for execution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/a3aengenharia.com.br\/servicos\/implementacao\/gestao-de-projetos\/\">Structure Project Controls<\/a><\/p>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Approving an SOW without creating a control reference reduces its value. The document needs to connect to the schedule and indicators that will be monitored.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/a3aengenharia.com.br\/servicos\/implementacao\/gestao-de-projetos\/\">Project Management and Project Controls<\/a> can turn WBS, milestones, schedule and costs into a baseline. Changes and deviations are then assessed against that reference.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The link can be structured as follows:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td>SOW element<\/td><td>Associated control<\/td><\/tr><tr><td>deliverable<\/td><td>WBS + milestone<\/td><\/tr><tr><td>team<\/td><td>mobilization plan<\/td><\/tr><tr><td>critical material<\/td><td>procurement\/submittal schedule<\/td><\/tr><tr><td>method<\/td><td>approved procedure<\/td><\/tr><tr><td>interface<\/td><td>action\/RFI register<\/td><\/tr><tr><td>inspection<\/td><td>ITP\/PIT<\/td><\/tr><tr><td>document<\/td><td>MDR<\/td><\/tr><tr><td>test<\/td><td>commissioning schedule<\/td><\/tr><tr><td>handover<\/td><td>closeout checklist<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">This prevents the SOW from being approved and then filed away without an operational function.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Release criteria: the gate must be explicit<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A pre-start gate or package-release gate works when there is an objective set of conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Example for an installation work front:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>design released for construction;<\/li><li>material approved and available;<\/li><li>area released;<\/li><li>team authorized;<\/li><li>method approved;<\/li><li>safety prerequisites met;<\/li><li>hold points identified;<\/li><li>applicable documents at the correct revision;<\/li><li>interfaces resolved;<\/li><li>evidence that the subsequent activity can be inspected\/tested.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The gate can release the entire project or only a package. In complex projects, package-based release makes it possible to maintain pace without sacrificing maturity control.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The proof of concept must also be designed to avoid risk cannibalization<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A less obvious mistake occurs when the organization uses the PoC to test many irrelevant things and fails to test the requirement that actually determines implementation success.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Scenario selection should start from the risk matrix. Ask:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>which requirement has the greatest impact if it fails?<\/li><li>which characteristic is difficult to prove through documents?<\/li><li>which incompatibility would have a high cost after contracting?<\/li><li>which scenario differentiates a compliant solution from one that is merely declared compliant?<\/li><li>which test can be performed objectively and proportionately?<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is not to maximize the number of tests. It is to maximize useful information for the decision.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to handle failure, adjustment and repetition in the PoC<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The tender documents should establish how events will be handled. Not every failure has the same nature.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There may be:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>a configuration error that can be corrected within the procedure;<\/li><li>failure of the environment supplied by the contracting authority;<\/li><li>a requirement not met by the solution;<\/li><li>external interruption;<\/li><li>an inconsistency in the script;<\/li><li>an inconclusive result.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Without a prior rule, each event becomes a discussion about correction opportunities, equal treatment and results.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The script needs to define whether repetition is allowed, under what conditions and with what record. The decision should not depend on improvisation during the test.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Technical audit when the process has already started without these barriers<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">It is not always possible to return to the preparatory phase. A contract may already be signed, with execution underway and doubts about documentation, solution, progress or compliance with the design.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this situation, it is not appropriate to invent a retroactive PoC to create a qualification effect. The SOW is an instrument for operational definition of the work and, together with the Execution Plan, transforms contractual obligations into method, resources, deliverables, controls and verifiable criteria.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The greatest benefit appears when these instruments form part of a larger architecture: mature requirements in the ToR, appropriate qualification, objective PoC, clear contract, SOW, Execution Plan, Design Review, baseline, pre-start gate, evidence-based inspection, testing and acceptance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is not to multiply documents.
