What Brazil Law 14,133 Requires Before Starting"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Brazilian Law 14,133\/2021 establishes, as a rule, that <strong>construction works or engineering services should not be executed without Detailed Design<\/strong>. Article 46, Paragraph 1 prohibits carrying out these objects without that level of detail, except for the specific situation under Article 18, Paragraph 3 for certain common construction works and engineering services when it is technically demonstrated that the absence of designs does not impair verification of the intended performance and quality standards. In practice, therefore, \u201cstart construction and detail it later\u201d should not be treated as a normal contracting method.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Detailed Design is the set of elements necessary and sufficient for complete execution of the work. It develops the solutions defined in the Basic Design, identifies services, materials and equipment, establishes technical specifications and reduces the room for interpretation that, during construction, usually appears as RFIs, rework, quantity changes, incompatibility among disciplines, scope disputes, contract amendments or delays. Responsibility for preparing it may vary according to the execution regime \u2014 including being part of the contractor\u2019s obligations \u2014 but the need for sufficient detailed-design information to exist before the respective execution remains a central governance issue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the public manager, the most useful question is not merely \u201cis there a file called Detailed Design?\u201d The question is: <strong>does the current document set allow the work to be executed, measured, inspected, tested and accepted without depending on essential decisions that have not yet been made?<\/strong> If the answer is no, there is a maturity gap that needs to be resolved before work fronts are released.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Law 14,133 calls Detailed Design<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Article 6, item XXVI, of Law 14,133 defines Detailed Design as the set of elements necessary and sufficient for complete execution of the work, with detailing of the Basic Design solutions, identification of the services, materials and equipment to be incorporated, and their respective technical specifications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This definition is important because it separates Detailed Design from three documents that are frequently confused in the contracting process: the Preliminary Technical Study, the Terms of Reference and the Basic Design.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/a3aengenharia.com.br\/conteudo\/artigos-tecnicos\/estudo-tecnico-preliminar-etp-obras-servicos-engenharia-contratacao\/\">Preliminary Technical Study for construction works and engineering services<\/a> characterizes the need and compares alternatives to support the chosen solution. The <a href=\"https:\/\/a3aengenharia.com.br\/conteudo\/artigos-tecnicos\/termo-de-referencia-engenharia-escopo-criterios-tecnicos-medicao-aceite\/\">Engineering Terms of Reference<\/a> organizes contracting conditions, requirements, responsibilities, measurement, acceptance and other rules applicable to the object. The Basic Design defines the solution at a level sufficient to characterize the work and its relevant elements. Detailed Design, in turn, takes that solution to the documentation level required for complete execution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This sequence is not merely bureaucratic. Each document answers different questions.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td>Artifact<\/td><td>Main question<\/td><td>Typical failure when insufficient<\/td><\/tr><tr><td>ETP<\/td><td>What need must be met and which solution is most appropriate?<\/td><td>contracting the wrong solution<\/td><\/tr><tr><td>Basic Design<\/td><td>What is the technical solution and how is the object characterized?<\/td><td>budgeting and tendering based on an immature scope<\/td><\/tr><tr><td>Detailed Design<\/td><td>How will each part actually be executed and integrated?<\/td><td>critical decisions transferred to the construction site<\/td><\/tr><tr><td>Terms of Reference<\/td><td>How will the object be contracted, measured, controlled and accepted?<\/td><td>conflicts over obligations and contractual criteria<\/td><\/tr><tr><td>Tender documents and contract<\/td><td>How will competition take place and how will responsibilities be allocated?<\/td><td>non-comparable bids, claims and disputes<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The article on <a href=\"https:\/\/a3aengenharia.com.br\/conteudo\/artigos-tecnicos\/projeto-basico-projeto-executivo-diferencas\/\">Basic Design vs. Detailed Design<\/a> explores the difference between the two levels. For public procurement, however, the decisive point is recognizing that Detailed Design needs to be connected to the execution regime and contracting strategy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The rule in Article 46: construction should not be executed without Detailed Design<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Article 46 of Law 14,133 lists the permitted regimes for indirect execution of construction works and engineering services. Paragraph 1 prohibits carrying out construction works and engineering services without Detailed Design, except for the situation under Article 18, Paragraph 3.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This rule should be read technically. It does not necessarily mean that all detailed-design documentation for the entire project must be complete on the same day the tender is published. Under certain contractual arrangements, Detailed Design may be developed by the contractor itself. It does mean, however, that physical execution cannot routinely advance over technical decisions that have not been sufficiently developed when Detailed Design is required to execute that stage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In other words, <strong>contracting before part of the design is complete may be compatible with certain regimes; building without sufficient Detailed Design is not the normal model permitted by law<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction is central in larger projects. A project can work with progressive development of packages, provided there is interface governance, formal approval, configuration control and release of work fronts only after the corresponding detailing has been completed. The problem arises when \u201cdesign under development\u201d is used as a synonym for \u201cwe will solve it in the field.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who prepares Detailed Design depends on the contracting regime<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Law 14,133 clearly distinguishes integrated and semi-integrated contracting regimes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under integrated contracting, the contractor assumes responsibility for preparing and developing both Basic Design and Detailed Design, as well as executing the work and all other activities required for final delivery of the object. Under semi-integrated contracting, the contractor assumes development of Detailed Design based on the Basic Design provided by the Public Administration, subject to the rules of that regime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under other regimes, the legislation also allows preparation of Detailed Design to be assigned to the contractor, according to the structure of the procurement. This does not eliminate the Administration\u2019s responsibility to provide the prior elements appropriate to the chosen regime, nor does it authorize essential uncertainties to be transferred through generic clauses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The article on <a href=\"https:\/\/a3aengenharia.com.br\/conteudo\/artigos-tecnicos\/contratacao-integrada-semi-integrada-engenharia-diferencas-riscos\/\">Integrated and Semi-Integrated Contracting in Engineering<\/a> details these differences. In practice, the matrix below helps explain the logic.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td>Situation<\/td><td>Technical basis provided by the Administration<\/td><td>Detailed-design development<\/td><td>Control point<\/td><\/tr><tr><td>Traditional works contract<\/td><td>Mature Basic Design and other required elements<\/td><td>may already exist or be assigned as a defined obligation<\/td><td>execution only with released detailed-design package<\/td><\/tr><tr><td>Semi-integrated<\/td><td>Administration\u2019s Basic Design<\/td><td>contractor develops Detailed Design<\/td><td>compliance with Basic Design and change rules<\/td><\/tr><tr><td>Integrated<\/td><td>Preliminary design and performance requirements<\/td><td>contractor develops Basic Design and Detailed Design<\/td><td>traceability of requirements and approvals<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Regardless of the strategy, the public entity needs to know <strong>who decides, who designs, who approves, who verifies and at which milestone execution is released<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The exception in Article 18, Paragraph 3 is not a general authorization to build without design<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Article 18, Paragraph 3 addresses a specific situation involving common construction works and engineering services. When it is demonstrated that there is no impairment to verification of the intended performance and quality standards, the object may be specified only through Terms of Reference or Basic Design, dispensing with preparation of designs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decisive point is the technical demonstration. The exception should not be applied merely because an object is nominally classified as \u201ccommon.\u201d It is necessary to assess whether the solution can be objectively standardized and whether the absence of design will not impair quantities, performance, quality, safety, inspection, price or acceptance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Small standardized interventions may fit differently from multidisciplinary renovations, critical installations or projects with strong interface dependency. An apparently simple service may require design when the existing condition is unknown or when the intervention affects interdependent systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, before invoking the exception, the planning team should answer:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>is the object sufficiently characterized by objective requirements?<\/li><li>can quantities be defined and verified without design development?<\/li><li>are there relevant interfaces with existing installations?<\/li><li>are there safety risks that depend on calculation, sizing or coordination?<\/li><li>would different suppliers interpret the scope equivalently?<\/li><li>will the inspection team have objective criteria to measure and accept the service?<\/li><li>does the absence of design increase price uncertainty or transfer decisions to the executor?<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If these answers reveal material uncertainty, the apparent simplification may simply shift the cost of design into execution.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What happens when construction starts with insufficient detailed-design documentation<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A lack of Detailed Design rarely appears on site under that name. It manifests as a sequence of operational symptoms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The first is an increase in RFIs. The field team encounters a decision that the document did not resolve and asks the designer or inspection team. A moderate number of RFIs is normal in complex projects; a high number involving basic decisions about geometry, specification, interfaces and positioning signals insufficient maturity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The second symptom is the creation of solutions directly by the contractor without a formal engineering process. This can occur through sketches, markings, messages, meetings or shop drawings that gradually begin to define the project without adequate traceability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The third is rework. When two disciplines make independent decisions in the field, the incompatibility appears after part of the installation has already been executed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fourth is the budget impact. Changes in quantity, method, material or solution begin to require price analysis and possible contractual treatment. Law 14,133 provides that changes resulting from design failures trigger investigation of the responsible technical professional, in addition to the necessary measures when damage to the Administration occurs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fifth is weak acceptance. Without consolidated design criteria, it becomes more difficult to answer whether the work was executed according to what should actually have been built.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Detailed Design is not merely graphic detailing<\/h2>\n\n\n\n<div class=\"wp-block-a3a-destaque\">\n<p class=\"wp-block-paragraph\">When the Administration already has a Basic Design but still lacks the level of detail needed to execute the work with traceability, the task should transform the approved solution into coordinated, verifiable detailed-design documentation consistent with the budget and acceptance criteria.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/a3aengenharia.com.br\/servicos\/planejamento\/projeto-executivo\/\">Detailed Engineering Design to take the solution to execution level<\/a><\/p>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">A common mistake is to assess maturity by the number of drawings. Detailed Design is an engineering information system, not a collection of drawings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the nature of the project, the package may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>drawings and construction details;<\/li><li>design narratives and design criteria;<\/li><li>calculation reports;<\/li><li>material and equipment specifications;<\/li><li>lists and quantities;<\/li><li>diagrams and functional schematics;<\/li><li>data sheets;<\/li><li>cable, instrument, circuit or asset lists;<\/li><li>interface details;<\/li><li>installation requirements;<\/li><li>inspection and testing criteria;<\/li><li>safety requirements;<\/li><li>BIM documentation and federated models, where applicable;<\/li><li>As-Built and handover requirements.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The composition varies by discipline. What does not vary is the need for the set to be <strong>consistent, coordinated, traceable and executable<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/a3aengenharia.com.br\/servicos\/planejamento\/projeto-executivo\/\">Detailed Engineering Design<\/a> service page describes this transition from concept and Basic Design to documentation suitable for execution, coordination, budgeting and control.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A design can be technically correct and still not be ready for construction<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Document quality needs to be assessed across more than one dimension.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Completeness<\/strong> verifies whether all required disciplines, areas and systems are represented.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Consistency<\/strong> verifies whether different documents say the same thing. Drawings, narratives, lists, specifications and the budget cannot point to incompatible solutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Coordination<\/strong> verifies whether disciplines occupy physical and functional space without conflicts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Constructability<\/strong> verifies whether the solution can be executed under real conditions of access, sequence, tolerance, logistics and safety.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Traceability<\/strong> makes it possible to identify the origin of a requirement, the current revision and the decision that generated a change.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Verifiability<\/strong> ensures that the result can be inspected, tested and accepted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The content on <a href=\"https:\/\/a3aengenharia.com.br\/conteudo\/artigos-tecnicos\/project-readiness-engenharia-avaliacao-prontidao-projeto\/\">Project Readiness in Engineering<\/a> applies exactly this logic: a project should only pass a given gate when the conditions required for the next phase have been demonstrated.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Coordination needs to occur before execution, not during the conflict<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Multidisciplinary projects concentrate risk at interfaces. Structure, architecture, electrical systems, plumbing, HVAC, fire protection, telecommunications, electronic security, automation, utilities and other disciplines compete for space, power supply, supports, routes and functional priorities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/a3aengenharia.com.br\/conteudo\/artigos-tecnicos\/projeto-multidisciplinar-engenharia-disciplinas-coordenacao-interfaces\/\">Multidisciplinary design coordination<\/a> should identify these interfaces before mobilization of the respective work fronts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a building, for example, lack of coordination can result in a cable tray crossing a duct, piping interfering with structure, a detector positioned outside the intended scenario, equipment without maintenance clearance or a panel installed without an adequate cable route.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In infrastructure, the consequence can be even greater: interference with existing networks, incompatible geometries, conflicting foundations, unavailable corridors or structures designed without construction access.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The cost of resolving the issue in the model and drawing is normally far lower than the cost of resolving it after installation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Record surveys and existing conditions are part of the problem<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In brownfield projects, renovations and expansions, Detailed Design depends on the quality of existing-condition surveys. Designing from outdated records is equivalent to detailing a reality that does not exist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before detailed-design development, record surveys, topography, point clouds, inspections, geotechnical investigations, testing, opening of verification points or identification of interferences may be required.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This need is consistent with the legal definition of Basic Design itself, which includes surveys and data sufficient to develop the solution without significant later redesign.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Engaging a <a href=\"https:\/\/a3aengenharia.com.br\/servicos\/levantamento-e-diagnostico\/levantamento-cadastral-edificacoes-instalacoes-infraestruturas\/\">Engineering Record Survey<\/a> is particularly important when the public entity lacks reliable As-Built documentation or when the object interferes with existing installations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The budget must correspond to the design revision that will be executed<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Another critical point is synchronization between design and budget. It is not enough to have both; they need to represent the same solution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the budget was prepared from an earlier revision, apparently small changes can alter relevant quantities. If certain equipment was replaced in the design narrative but the cost sheet continues to use the previous specification, the procurement process is already inconsistent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before contracting, it is advisable to reconcile:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>current drawings;<\/li><li>design narratives;<\/li><li>specifications;<\/li><li>quantities;<\/li><li>cost compositions;<\/li><li>schedule;<\/li><li>Terms of Reference;<\/li><li>risk matrix;<\/li><li>measurement and acceptance criteria.<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">This control reduces the likelihood that a bidder will find inconsistencies among annexes and price the work based on assumptions different from those considered by the Administration.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Terms of Reference do not correct deficient Detailed Design<\/h2>\n\n\n\n<div class=\"wp-block-a3a-destaque\">\n<p class=\"wp-block-paragraph\">Design, budget, Terms of Reference and tender documents need to represent the same solution. An independent technical review before publication identifies contradictions that, after contracting, tend to appear as clarifications, scope changes or contract amendments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/a3aengenharia.com.br\/servicos\/planejamento\/revisao-tecnica-termo-referencia-obras-servicos-engenharia\/\">Technical Review of Terms of Reference to verify consistency before tendering<\/a><\/p>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Detailed Terms of Reference help organize responsibilities, deliverables, measurement and acceptance, but should not be used to replace engineering information that belongs in the design.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Statements such as \u201cthe contractor shall perform all adaptations necessary for proper operation\u201d do not resolve an unknown design interface. On the contrary, they may create a false sense of contractual coverage while maintaining technical uncertainty without a clearly associated price.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The best Terms of Reference are those supported by a mature technical definition and that turn that definition into verifiable contractual obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When there are doubts about consistency between design and contracting documents, a <a href=\"https:\/\/a3aengenharia.com.br\/servicos\/planejamento\/revisao-tecnica-termo-referencia-obras-servicos-engenharia\/\">Technical Review of the Terms of Reference<\/a> makes it possible to assess scope, assumptions, interfaces, measurement, acceptance and compatibility with engineering annexes before publication.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to verify whether Detailed Design is ready to release a work front<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Instead of a generic approval of the entire project, complex projects can use release gates by package or system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A work front should be released when, at a minimum:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>applicable documents are identified and at an approved revision;<\/li><li>requirements from the previous phase have been incorporated;<\/li><li>critical interfaces are coordinated;<\/li><li>required surveys are complete;<\/li><li>compatible narratives and calculations are available;<\/li><li>main materials and equipment are specified;<\/li><li>quantities are reconciled with the budget where applicable;<\/li><li>access, safety and logistics constraints have been addressed;<\/li><li>inspection and testing criteria have been defined;<\/li><li>remaining open items do not prevent correct and safe execution.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This gate should leave evidence. In a future inspection, it is important to be able to reconstruct why a particular work front was authorized and which documentation was current at that time.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Detailed Design developed by the contractor requires owner governance<\/h2>\n\n\n\n<div class=\"wp-block-a3a-destaque\">\n<p class=\"wp-block-paragraph\">If the design will be developed by the contractor, the owner still needs to control requirements, interfaces, revisions, decisions and release gates. This governance reduces the risk of schedule pressure pushing execution ahead of immature documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/a3aengenharia.com.br\/servicos\/contratacao-integrada\/engenharia-do-proprietario\/\">Owner\u2019s Engineering for governance of detailed-design development<\/a><\/p>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">When Detailed Design is part of the contractor\u2019s scope, the Administration still needs engineering governance. The risk simply changes form.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The public entity needs to establish requirements, submission flows, comments, approvals, revision control, design-review criteria and treatment of deviations. It also needs to prevent schedule pressure from leading to execution from documents that have not yet been approved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In integrated and semi-integrated contracts, the contractor\u2019s technical freedom needs to coexist with performance requirements, project constraints and acceptance criteria.
