The document should not merely state that the contractor will perform \u201cengineering, procurement, and construction\u201d; it must establish which results will be delivered, where responsibilities begin and end, which information belongs to the Owner, how changes will be handled, and which evidence will demonstrate fulfillment of the obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Contract quality depends directly on the quality of its technical appendices. Owner requirements, reference engineering, Scope of Work, battery limits, responsibility matrix, risk matrix, schedule, performance criteria, quality plan, documentation requirements, and commissioning philosophy together form the contractual system. If these documents contradict one another or leave gray areas, the concentration of responsibility typical of EPC loses effectiveness and the project becomes exposed to exclusions, change orders, claims, and acceptance disputes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An EPC contract is also not automatically synonymous with a fixed lump-sum price, total risk transfer, or absolute turnkey delivery. These characteristics must result from coherent clauses, appendices, and mechanisms. The objective is to allocate each obligation to the party capable of performing or controlling it, preserve technical verifiability, and create a clear boundary among normal engineering development, scope change, assumed risk, and compensable event.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The EPC contract works as a system of documents<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In complex projects, the main contract rarely contains the entire technical definition by itself. It establishes commercial and legal conditions and incorporates appendices that materialize the object. The analysis must consider the <strong>document set<\/strong>, not only the main agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/a3aengenharia.com.br\/conteudo\/artigos-tecnicos\/scope-of-work-sow-escopo-trabalho-engenharia\/\">Scope of Work in Engineering<\/a> describes activities and deliverables; Owner requirements define the expected function and performance; drawings and design narratives delimit the reference engineering; the responsibility matrix separates assignments; and the risk matrix defines the consequences of events.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An inconsistency among documents can be more dangerous than a missing clause. If the design narrative requires a certain performance, the equipment list indicates another configuration, and the EPC contractor&#8217;s proposal contains an incompatible exclusion, it will be necessary to determine which document prevails. Therefore, contractual hierarchy and the treatment of discrepancies must be formalized.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Order of precedence and document compatibility<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The contract should state how conflicts among documents will be resolved. This mechanism should not replace technical review: ideally, inconsistencies are eliminated before signature. The order of precedence serves as a residual mechanism when a discrepancy still exists.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During bid leveling, bidder qualifications and exclusions must be explicitly incorporated or rejected. Accepting a commercial proposal without consolidating its reservations into the final instrument may create two competing interpretations of the object.<\/p>\n\n\n\n<figure class=\"a3a-mermaid\"><svg
