In engineering procurement, analysis should not be reduced to searching for identical words in the certificate and the tender documents. The central question is whether the proven experience demonstrates professional and\/or corporate technical capacity appropriate to the <strong>characteristics, technological complexity, scale and relevant conditions<\/strong> of the future contract, within the limits established by Brazilian Law No. 14,133\/2021 and the tender instrument itself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the public body, the challenge is twofold. Insufficient requirements may allow qualification of a company that has not demonstrated capacity to execute the object. Excessive requirements, on the other hand, may improperly restrict competition, increase prices, generate challenges or exclude technically capable bidders. Criteria therefore need to arise from a technical analysis of the portions that are truly relevant to the procurement and be evaluated objectively, proportionately and with proper documentation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A certificate should also not be treated as absolute proof that the company will perform the new contract well. It demonstrates prior experience only to the extent actually documented. The Administration still needs to compare scope, quantities, complexity, responsibilities, professionals, execution conditions and any diligence findings before reaching a qualification decision.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What a technical capacity certificate actually proves<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A certificate proves a declared and documented prior experience. It should allow the Administration to identify <strong>who performed the work, for whom, what the object was, which portion was executed, in what quantity, with which characteristics and, when applicable, under the responsibility of which professionals<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The document should not be interpreted in isolation when its content is insufficient to clarify the experience. The contract, Work Orders, spreadsheets, invoices, certificates, professional records, technical-acervo documents and other elements may be needed to confirm an existing condition or clarify what was actually executed, subject to the tender rules and legislation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In practice, the correct question is not:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u201cDoes the certificate mention exactly the same name as the object?\u201d<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u201cDoes the proven experience demonstrate capacity to execute the technically relevant portions of this object?\u201d<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This shift avoids both automatic acceptance of generic documents and improper rejection of technically equivalent experience.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Professional technical qualification and corporate technical qualification are not the same<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Article 67 of Brazilian Law No. 14,133\/2021 addresses documentation relating to professional technical qualification and corporate technical qualification. Although related, they answer different questions.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td>Dimension<\/td><td>Central question<\/td><td>Typical evidence<\/td><\/tr><tr><td>Professional technical<\/td><td>Is there a professional with compatible experience and technical responsibility?<\/td><td>designated professional, registration with the competent professional council when applicable, and proven technical experience<\/td><\/tr><tr><td>Corporate technical<\/td><td>Does the organization demonstrate capacity to execute services of equivalent or greater technological and operational complexity?<\/td><td>certificates, attestations and other documents permitted by law and the tender documents<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Professional technical qualification<\/strong> relates to the experience of the professionals who will bear technical responsibility for the work. The law provides for presentation of a professional, duly registered with the competent professional council when applicable, who holds evidence of technical responsibility for execution of works or services with similar characteristics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Corporate technical qualification<\/strong> relates to the capacity of the company or organization to mobilize processes, structure, resources and experience to execute an object of compatible complexity. Article 67 also provides for certificates or attestations demonstrating operational capacity in similar services of equivalent or greater technological and operational complexity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This separation is essential. A company may employ a professional with an excellent technical record and still need to demonstrate corporate capacity when the tender legitimately requires it. Likewise, an extensive corporate history does not replace the need for a qualified professional when the activity requires specific technical responsibility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/a3aengenharia.com.br\/conteudo\/guias-tecnicos\/guia-completo-sobre-licitacoes-e-contratos-de-engenharia\/\">Complete Guide to Procurement and Contracts for Engineering Works and Services<\/a> places qualification within the complete procurement process, from planning through inspection and receipt.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Certificate, ART\/RRT and CAT: related documents with distinct functions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In engineering and architecture, the analysis commonly involves documents issued by or registered with professional councils. However, the public body should not treat all acronyms as equivalent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An ART, RRT or corresponding document records technical responsibility according to the profession and applicable council. Within Brazil&#8217;s Confea\/Crea system, the CAT is linked to the professional technical record and certifies activities recorded for the professional under the council&#8217;s rules. The certificate issued by the contracting client, in turn, describes the experience and the object performed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The documentary form that may be required depends on the type of qualification, the object, the competent council and what the legislation permits. Tender documents should therefore avoid generic formulas such as \u201ccertificates registered with CREA\u201d without verifying whether the requirement actually corresponds to the nature of the evidence sought.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The technical point is to separate three dimensions:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>who assumed technical responsibility<\/strong>;<\/li><li><strong>what was actually executed<\/strong>;<\/li><li><strong>which experience belongs to the professional and which belongs to the organization<\/strong>.<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Mixing these dimensions can result in either improper qualification or unnecessary restriction of competition.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The tender should require similar experience, not necessarily identical experience<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">TCU case law reinforces that technical qualification requirements should admit prior experience in works or services with <strong>similar characteristics or greater complexity<\/strong>, rather than necessarily requiring experience identical to the future object.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This principle is especially important in engineering because the same competence may appear in projects under different terminology.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Example: a tender for a video-surveillance implementation may require relevant experience in IP architecture, VMS, storage, integration and commissioning. A prior certificate may use different expressions, such as \u201cintegrated security system,\u201d \u201cIP CCTV,\u201d \u201cvideo management platform\u201d or \u201cmonitoring center.\u201d The technical analysis needs to identify the content actually performed rather than only literal word matching.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reverse is also true. A document whose title appears similar may not prove the relevant portion. A certificate titled \u201csecurity system implementation\u201d may have involved only equipment supply, without integration, design, installation, testing or documentation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For this reason, the analysis needs to examine the <strong>actual scope<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Most relevant or significant-value portions<\/h2>\n\n\n\n<div class=\"wp-block-a3a-destaque\">\n<p class=\"wp-block-paragraph\">Technical capability criteria need to originate from the relevant portions and the actual risk of the object. Requiring more documents does not make procurement safer if they do not demonstrate the capability that truly matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/a3aengenharia.com.br\/servicos\/servicos-transversais\/apoio-tecnico-licitacao-analise-propostas-engenharia\/\">Structure technical support for engineering tenders<\/a><\/p>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Brazilian Law No. 14,133\/2021 restricts the requirement for certificates to the most relevant or significant-value portions of the object. Article 67 establishes that, for this purpose, significant-value portions are those with an individual value equal to or greater than 4% of the total estimated procurement value.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The logic is to prevent the public body from turning every item in the bill of quantities into a prior-experience requirement. That could require the bidder to have already executed an almost perfect copy of the new contract, reducing competition without a proportional technical benefit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The selection of portions must be justified. In engineering, relevance may involve not only the highest-value items, but also activities whose failure would represent technical risk disproportionate to the project, provided the legal framework and justification are properly structured.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A simple matrix can help:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td>Portion<\/td><td>Relative value<\/td><td>Technical criticality<\/td><td>Complexity<\/td><td>Require evidence?<\/td><td>Justification<\/td><\/tr><tr><td>Main system<\/td><td>high<\/td><td>high<\/td><td>high<\/td><td>yes<\/td><td>core capability of the object<\/td><\/tr><tr><td>Auxiliary infrastructure<\/td><td>medium<\/td><td>medium<\/td><td>low<\/td><td>assess<\/td><td>depends on actual relevance<\/td><\/tr><tr><td>Accessory item<\/td><td>low<\/td><td>low<\/td><td>low<\/td><td>normally no<\/td><td>requirement may be disproportionate<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The decision must be linked to planning and to the Basic Design or Terms of Reference. If the Administration cannot explain why that portion requires prior experience, the qualification criterion probably needs to be reviewed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Minimum quantities: how far may the Administration require them?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Subject to Article 67, paragraphs 1 and 2, the Administration may require certificates with minimum quantities of up to <strong>50% of the portions<\/strong> qualified under the legal criteria. The law also prohibits time limitations and restrictions to specific locations relating to certificates under these conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This does not mean that 50% should be used automatically. It is a limit, not a target. The quantity must be related to the risk and to what actually demonstrates capability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A 50% requirement may be defensible for a particular critical activity and unnecessary for another. From an engineering standpoint, the team should ask:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>what minimum scale demonstrates that the bidder has already faced similar complexity?<\/li><li>does the difficulty increase linearly with quantity?<\/li><li>is there a technical benefit in requiring a high quantity?<\/li><li>does the object allow aggregation of experience?<\/li><li>does the criterion exclude capable companies without improving procurement safety?<\/li><li>is there a specialized portion that may be subcontracted as permitted by law?<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The technical justification must be documented before the tender.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to compare a technical capability certificate with the tender object<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The analysis should be structured, not intuitive. A compliance matrix reduces subjectivity and facilitates any required due diligence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A practical methodology is to compare seven dimensions.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1. Nature of the service<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Identify whether the experience involves design, construction, installation, integration, supervision, inspection, maintenance, consulting, commissioning, supply or a combination of these activities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A company that only supplied equipment does not necessarily demonstrate experience in integration and commissioning. Likewise, a company that prepared the design does not necessarily demonstrate construction execution when the tender requires operational capability in that activity.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Scope actually performed<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Read the details of the certificate and supporting documents. Verify activities, deliverables and responsibilities.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Technological complexity<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Compare technologies, interfaces, integrations, level of automation, criticality, redundancy, operations and performance requirements.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Operational complexity<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Assess occupied environments, operational continuity, multiple sites, access restrictions, shifts, logistics, third-party interfaces and coordination requirements.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5. Relevant quantities<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Compare only the quantities related to the portions that actually need to be demonstrated.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6. Responsibility of the bidder or professional<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Verify whether the document demonstrates that the company or professional was actually responsible for the claimed portion, especially in consortia, subcontracting arrangements or multidisciplinary contracts.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">7. Result and conclusion<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Identify whether the document confirms execution\/completion and whether there is sufficient evidence to support the qualification
