Brazil\u2019s Law No. 14,133\/2021 allows the Public Administration to hire third parties to assist and support the contract inspector with information relevant to inspection and oversight. This is particularly important in engineering works, critical systems, and multidisciplinary contracts where the public entity does not internally have all specialists required to verify designs, execution, documents, tests, measurements, and receipt conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This support, however, does not turn the Consulting Engineering firm into the contract inspector. The inspector remains the agent appointed by the Public Administration, with duties and responsibilities defined by law, the applicable regulation, and the contract itself. The third party may contribute technically, but:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>may not exercise duties that are specifically and exclusively assigned to the inspector;<\/li><li>assumes strict civil liability for the truthfulness and accuracy of the information provided;<\/li><li>the engagement does not exempt the inspector from responsibility, within the limits of the information received from the contracted third party.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This framework matters because it allows the Public Administration to obtain specialized expertise without confusing <strong>technical assistance<\/strong> with <strong>delegation of the public inspection function<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a multidisciplinary contract, for example, the inspector may receive reports prepared by specialists in electrical engineering, automation, telecommunications, electronic security, HVAC, structures, quality, or commissioning.
